Yes they took all the consequence of using certain magic out of the game a long time ago, as well as any spell durations longer than "encounter" length. Some of the reasons why it isn't great for running actual campaigns.

Not aging has zero effect on the Haste Spell. In either 5th edition ot ToV

Is it safe to say that Tales of the Valiant is the closest to being a 5E clone that is available?
I'm glad for you if you like the top selling game of the genre.  Me, I like the road less travelled, and will be the player asking we try a game you've never heard of.

I would say it most certainly is. The Black Flag SRD is very much just the 5e SRD reprinted under a new license with very minor changes in some areas. Personally I would go as far to say that ToV is the slightly superior version of 5e, but that's personal preference and your mileage may vary.

I don't own TotV, but RPGBot has posted a "5e to Tales of the Valiant Transition Guide." With close to 8 screens of changes listed, it looks like more of a 5.5 than a clone.
