While the KS project in question seems more designed to simply scam people, I wonder if this won't set a precedent for any KS projects that fail to deliver.
I don't see how he's ever going to collect, being in a different state.

Me either, but the fact that they're even trying to prosecute might throw a bit of a damper on those KS projects that are long on hype and short on business plan.

They are not really obligated to deliver... thats the problem.
All they have to prove is that they tried, but failed and bum your money is gone.
